Terms of sale

1 — Scope and seller
These terms govern sales of photography services and related products (prints, personalised items, digital files) between Sema Photographie, sole proprietorship, SIREN 931 365 068, 15 rue de l'École, 67800 Bischheim, France (contact@semaphotographie.fr) and consumer clients.
2 — Services and ordering
The photo session is agreed when booking. After the session, the client accesses a private gallery with a personal code, selects photos and may order products. The order is final upon validation in the gallery.
3 — Prices
Prices are in euros. VAT not applicable, art. 293 B of the French Tax Code. Any delivery costs are shown before the order is confirmed.
4 — Payment
Payment is made online by card (via Stripe) or in cash upon collection, as chosen at checkout.
5 — Delivery
Products are handed over at the studio or shipped to the address provided, depending on the chosen option. Digital files are provided through a secure, time-limited download link.
6 — Right of withdrawal
Under article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised — which is the case for prints and products made from the client's photographs. Nor does it apply to services fully performed before the end of the withdrawal period with the consumer's agreement (art. L221-28 1°). The client is informed of this before confirming the order.
7 — Legal warranties
Products are covered by the French legal warranty of conformity (art. L217-3 et seq. of the Consumer Code) and the warranty against hidden defects (art. 1641 et seq. of the Civil Code).
8 — Complaints and mediation
Complaints may be sent to contact@semaphotographie.fr. In accordance with articles L611-1 et seq. of the French Consumer Code, the client may use a consumer mediator free of charge to resolve a dispute amicably. The mediator's details are provided on request.
9 — Intellectual property and image rights
Photographs remain the intellectual property of Sema Photographie. The order grants the client a private-use right over the delivered photographs. Any showcase use of client photographs by Sema Photographie requires prior written consent.
10 — Personal data
Personal data processing related to orders is described in the privacy policy, linked in the site footer.
11 — Governing law
These terms are governed by French law. Failing an amicable resolution, French courts have jurisdiction under ordinary rules.
